Terms of Use

These Terms of Use apply to the alligkeit app.

1. Provider and scope

The provider of alligkeit is the person named in the Legal Notice. These Terms govern the use of the app and its features.

If you obtain the app through the Apple App Store, the license and use of the app on Apple devices are governed by Apple's standard end-user license agreement ("Licensed Application End User License Agreement"). These Terms additionally govern the alligkeit services, cloud features, content, and subscriptions. In case of conflict, the Apple standard EULA takes precedence only for the app license and Apple Usage Rules. Mandatory consumer rights remain unaffected. Apple is not the provider of the alligkeit features and is not a party to these Terms.

Before first using the cloud features, you affirmatively accept these Terms in the app through a separate checkbox. The app records the accepted version and acceptance time locally on your device. Your separate consent to cloud processing can be withdrawn at any time; withdrawal disables further cloud processing but does not retroactively undo your acceptance of these Terms. If a new version requires renewed acceptance, the cloud features remain disabled until you accept it.

2. What alligkeit is

alligkeit transforms your free speech into confirmed, personal sentences and creates replayable audio sessions from them. Your sessions are stored locally on your device. There is no user account.

To understand, rephrase, and voice your words, the app uses cloud services from external providers — but only if you have explicitly consented to cloud processing. Details, providers, and your rights are described in the Privacy Policy.

The cloud features depend on external services and may be temporarily unavailable. Locally stored sessions generally remain playable. Your mandatory statutory rights concerning non-supply or defects of digital products remain unaffected.

3. Minimum age

alligkeit is intended for persons aged 16 and over. Cloud processing requires that you confirm being at least 16 years old before giving consent (details: Privacy Policy, section 3a).

4. Your content and AI-generated audio

Your content stays yours. We do not claim ownership of your voice recordings, transcripts, or confirmed sentences. You grant us, ElevenLabs, its affiliates and subcontractors, and the other service providers used for the cloud features a non-exclusive, royalty-free right, limited solely to providing, securing, and supporting the features you request, to store, reproduce, transmit, technically modify, and convert this content into audio. This right applies only to the extent and for as long as the relevant processing is necessary for those purposes; statutory retention duties remain unaffected.

AI-generated voice tracks: The voice tracks created in the app are synthetic audio content (AI voice) generated using ElevenLabs services. To the extent transferable or licensable rights exist in a voice track and we are entitled to grant them, we grant you a non-exclusive, perpetual, royalty-free right to use it for private, non-commercial purposes — including export and sharing within your private sphere. We do not promise exclusivity, copyright protection, or freedom from third-party rights.

Honest limits: Under current law, AI-generated audio content may not enjoy copyright protection. The AI voices used are not exclusive to you — similar-sounding or identical audio may also be generated for other users. The app visibly labels the synthetic voice ("AI voice") and adds technical audio metadata describing its AI origin. Such metadata can be removed during conversion or sharing and is not, by itself, a robust guarantee of origin. You must not conceal the synthetic origin when sharing.

5. Not a medical product

alligkeit is a tool for self-reflection and well-being. The app is not a medical device, therapy service, or emergency service, does not provide medical, psychological, or therapeutic treatment, and does not replace such treatment or professional advice. Inputs are not continuously monitored by people. Automated crisis detection can miss warning signs and must not be relied on as a safety mechanism. If there is immediate danger, call your local emergency number; if you are acutely unwell, seek medical or licensed mental-health support.

6. Acceptable use

When using alligkeit, you must not:

• speak in or generate content that is unlawful or infringes the rights of third parties,
• misuse the AI features — for example, to deceive others about the synthetic nature of the audio,
• circumvent or disrupt technical safeguards of the app or the alligkeit infrastructure (e.g., volume and abuse limits).

Use of the AI voice is additionally subject to the ElevenLabs Prohibited Use Policy linked at clickwrap and, from the ElevenLabs Terms of Use, solely to the substantive conduct rules on permitted use (prohibited content and prohibited forms of use). The remaining provisions of the ElevenLabs Terms of Use — in particular provisions on contract formation, account, payment, and minimum age — are not incorporated into this agreement; section 3 alone governs the minimum age. In particular, you must not use the AI features for deception, unauthorized impersonation or identity misuse, harassment, exploitation, promotion of violence or self-harm, violations of privacy or intellectual-property rights, unlawful discrimination, or circumvention of technical safeguards. If an incorporated conduct rule changes materially for your use, renewed acceptance is required before another cloud request.

ElevenLabs and its affiliates are intended third-party beneficiaries of the provisions concerning the ElevenLabs services and their permitted use and may enforce those provisions in their own name. Nothing in these Terms creates a partnership, representation, or agency relationship between you, us, and ElevenLabs.

In the event of violations, we may technically limit or block the cloud features for the affected installation.

7. "ritual" subscription, prices, and cancellation

Free use: You can use alligkeit without a subscription. Free use includes a limited number of sessions with your own voice per calendar month (7 in the first month, 5 thereafter). Listening to sessions you have already created is always unlimited.

"ritual" subscription: The AI voice is available to subscribers. "ritual" is an auto-renewing monthly or yearly subscription that you purchase in the app through your Apple account:

• Price and billing period: Before purchase, the App Store displays the localized total price, currency, billing period, and any applicable taxes. Those checkout details govern the specific purchase.
• Each subscription month includes 21 session credits. The yearly subscription also grants 21 credits at the start of each subscription month; yearly payment does not change this monthly cadence. Unused credits roll over until the shared total balance reaches no more than 60 credits.
• Your credit balance is authoritatively maintained on the server and linked pseudonymously to your Apple-verified subscription transaction. After successful verification or "Restore purchases", the same balance is therefore available on your devices insofar as they use the same verified Apple subscription. Your sessions and audio files remain separate, stored locally or in your operating-system backup; they are not synchronized through the credit balance.
• With AI voice, one credit is used once the speech-synthesis provider has successfully completed the requested generation. This happens on the server before the response necessarily arrives in full on your device — even if you later discard the preview and do not save the session. If generation fails before that point, the reservation is released. In the rare event that provider generation succeeded but the response is lost in transit before it reaches you, the credit may technically already have been used. Contact Support in that case; after technical review, we may restore the credit as a goodwill credit. Mandatory statutory rights remain unaffected.
• With your own voice, one credit is used only after the session has been saved successfully on your device. If saving fails, no credit is used.
• The subscription renews automatically until you cancel it through your Apple account's subscription settings. Cancellation takes effect at the time Apple displays there, normally at the end of the current billing period. Any additional statutory cancellation or refund rights, or rights Apple provides for your storefront, remain unaffected.
• When termination takes effect, access to the AI voice ends and no new subscription credits are issued; sessions you already created remain stored locally and playable. Remaining credits are retained in the pseudonymous credit balance but cannot be used without an active subscription. If the same verified Apple subscription later becomes active again, they become usable again; new grants still increase the balance only up to 60 credits.
• A purchase-price refund granted by Apple is separate from session credits: it does not create an additional credit grant, cash payout, or monetary value for credits. At the current MVP stage, credits already granted but not yet used may remain in the balance as a goodwill treatment; they can still be used only while an Apple-confirmed subscription is active. Mandatory rights relating to the refund remain unaffected.
• Switching devices or reinstalling: The subscription and its server-side credit balance can be restored via "Restore purchases" with the same Apple account. Your created sessions are separate and form part of your operating system's backup: if a device is restored from that OS backup, they may be preserved (see Privacy Policy § 6). On a plain reinstall without restoring an OS backup, local sessions are not preserved.

Fair use: To protect against abuse, a technical limit of 20 AI generations per day and installation additionally applies (see section 6 — volume and abuse limits).

Purchase, withdrawal, and refunds through Apple: Where shown at checkout, Apple Distribution International Ltd. is the merchant for the App Store transaction and handles purchase, payment, withdrawal, and refunds under the Apple Media Services Terms applicable to your storefront. Apple provides the withdrawal instructions and contact channels there; "Report a Problem" is an additional practical refund route. Your statutory rights remain unaffected.

8. Changes

We continue to develop alligkeit. During ongoing supply, changes beyond those necessary to maintain conformity are made only for a valid reason provided in these Terms, in particular changed legal or security requirements, necessary adaptations to operating systems or external services, technical interoperability, or feature development without improperly reducing the contractually owed core performance. The change does not create additional costs for you.

We provide clear and understandable information about changes. If a change more than insignificantly impairs access or usability, we inform you in the app within a reasonable period in advance, in a form you can store unchanged, including its timing, content, and your statutory rights. In particular, your right to terminate the contract free of charge within 30 days under the conditions of Section 327r of the German Civil Code remains unaffected. Where renewed acceptance is legally or contractually required, the affected cloud features remain disabled until acceptance. Changes applying only to future contracts take effect only after valid incorporation.

9. Liability

We are liable without limitation for intent and gross negligence by us, our legal representatives, or agents, for culpable injury to life, body, or health, under the German Product Liability Act, for assumed guarantees, fraudulently concealed defects, and in all cases of mandatory statutory liability.

In cases of slight negligence, we are liable only for the breach of essential contractual obligations (obligations whose fulfillment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely), limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded.

10. Final provisions

German law applies. If you are a consumer, mandatory protective provisions of the state of your habitual residence remain unaffected.

These Terms are available in a German and an English version. To the extent permitted by law, the German version is authoritative; mandatory consumer rights and consumer-favourable interpretation rules remain unaffected.

Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.

We are neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board (Section 36 of the German VSBG).
